Open Discussion Items:
1) At a minimum, the electrical box and wiring of the front gate needs to be replaced.
Also, Hawaiian statute requires that exit be automatic. The question is this. While that
work is being done, should the entry gate be replaced with something more impressive?
a. Discussion on this item resulted in these recommendations and priorities.
Replace electrical box and upgrade all wiring. Put automatic exit loop in place.
Seal cracks on paved road. Bring road edge to grade. Purchase new motors and
arms. This will use our budget and some savings, so no other upgrades were
recommended this fiscal year.
2) Should KGE research purchasing the property housing the blue cabin at the entrance for
future as a community site?
a. Very solid “yes” to this proposal.
3) A bitter pill to swallow is the reality that the cost of paving side roads continues to
exceed the money we’ve banked. The main road was paved by imposing a special
assessment on each parcel. Should this avenue be utilized to secure funding for paving
side roads?
a. Very solid “no” to this suggestion.
4) What should the increased road assessment fee be for owners deemed to be using KGE
roads for commercial purposes, thus in excess of “normal” residential usage? Examples
would be owner operations requiring non-residential water deliveries, or heavy
equipment owners who traverse the road hauling equipment to work sites, or
operations with a large number of employees, etc? The bylaws allow for an increased
assessment, but no amount is specified. What do the owners think is fair?
a. Owners supported this proposal. A suggestion was made to charge 10 times the
residential assessment which would be $2000/year. Also, it was reported that
Ocean View Ranchos charges water delivery companies a yearly fee to use the
private roads. This will be confirmed and considered.
5) Kona Garden Estates Service Corporation has authority over roads and common
properties with minimal control over what is placed and constructed on any parcel. Our
zoning is agricultural. There are uses which are non-compliant with that zoning such as
mechanical businesses and vehicle storage sites. But we all know the State of Hawaii is
complacent, at best, in enforcement. As owners, we can exert control over our
development by putting CCR’s or HOA’s in place. Is beginning this process a direction
owners would like the board to take?
a. Pretty strong “no” to this suggestion.
